When is it Medical Malpractice?
Not every bad medical outcome occurs because of negligence. Sometimes even the most diligent medical providers do their very best and their patients have a bad outcome through no fault of the medical providers.
However, you should begin to suspect medical malpractice if:

Major injury or death occurs during surgery, particularly a routine surgery;

You or your loved one went to the hospital for one medical issue but you suffer a completely unrelated injury;

There is a long delay in diagnosis of any condition that leads to an irreparable injury or death, especially if it is a treatable condition that cannot be treated any longer due to the delay;

You have a long and difficult labor and delivery, and you are told your child has a brain injury even though there was plenty of time to perform a Cesarean section;

You present to the emergency department, and you are not seen for many hours resulting in a severe worsening of condition or death;

A sick or elderly person falls during transport, going to the restroom, or from their bed and suffers a severe fracture or brain injury;

A patient who presents to the doctor with unusual, out of proportion, and unrelenting pain but is discharged without treatment and a diagnosis is missed resulting in severe injury or death;
